These Terms & Conditions ("Terms") govern your use of the Awake iOS app and the awakeapp.net website (together, the "Service"), operated by Awake ("we", "us", "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Acknowledgment

These Terms apply to all visitors and users of the Service. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.

Eligibility and accounts

You must be able to form a binding contract to use the Service. If you create an account or profile within Awake, you're responsible for keeping your device and any credentials secure and for all activity that happens under your account. You may delete your account and associated data from within the app's settings at any time.

Subscriptions and in-app purchases

Awake may offer optional paid subscriptions ("Pro") and in-app purchases through Apple's App Store. Pricing, billing, renewal, cancellation, and refunds for these purchases are handled by Apple under Apple's own terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, via your Apple ID account settings. We may change prices for future billing periods; where required, we will notify you in advance.

Early Adopter pre-launch offer

The Early Adopter offer is an optional pre-launch reservation sold through Stripe for a one-time $5 payment. It is not an Apple App Store purchase and does not create a recurring subscription. If the app is released, the offer includes lifetime access to Awake for the purchaser's personal use, priority consideration for TestFlight beta access, and a Founding Member badge, subject to the app's availability and these Terms.

You may request a full refund before app access is granted by emailing info@awakeapp.net from the email address used at checkout. We will process eligible refunds through Stripe. Stripe's terms and privacy policy apply to the payment transaction.

Free trials

If we offer a free trial, any unused portion is forfeited once you purchase a subscription, and the subscription will begin billing automatically at the end of the trial unless cancelled beforehand.

Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Reverse engineer, decompile, or attempt to extract the source code of the Application, except as permitted by law.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its related systems.
• Use the Service to harass, abuse, or harm another person.

Missions, alarms, and app blocking

Awake's mission-based alarms, timers, habits, and app-blocking features are provided as productivity and accountability tools. They are not medical devices, sleep treatment, or a substitute for professional medical advice. Apple's Screen Time / Family Controls framework has known platform limitations (for example, it cannot guarantee prevention of app deletion or device reset); Awake makes reasonable efforts within what iOS allows but cannot guarantee complete enforcement.

Feedback and feature requests

If you send us feedback, feature ideas, or custom requests, you grant us a non-exclusive, royalty-free, worldwide license to use them to improve the Service, without any obligation to compensate you or implement your suggestion.

Intellectual property

The Service, including its design, graphics, text, and underlying code, is owned by us or our licensors and is protected by copyright, trademark, and other laws. These Terms do not grant you any right to our trademarks or branding.

Third-party links

The Service may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, privacy policies, or practices of any third-party sites. Payments are processed by Stripe, which is an independent payment processor.

Termination

We may suspend or terminate your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may stop using the Service and delete the app at any time.

Disclaimer

The Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or profits, arising from your use of or inability to use the Service.

Governing law

These Terms are governed by the laws applicable in our place of business, without regard to conflict-of-law provisions, except where local consumer protection law requires otherwise.

Changes to these terms

We may update these Terms from time to time. If changes are material, we will provide reasonable notice before they take effect. Continued use of the Service after changes take effect means you accept the updated Terms.
